Further to our Important Notice 4, we would hereby announce and clarify the following:

1. Hi-Tech Pro is the only brand of our products being handled by our company.

2. Our company have not appointed nor authorized anybody to appoint Sherex Engineering Ltd or its associated company in Hong Kong or China as the manufacturer of Hi-Tech Pro products.

3. Our company have not appointed nor authorized anybody to appoint Sherex Intumescent Fire Shutter Company Ltd. or its Director LEUNG Ka Yan as the agent of Hi-Tech Pro products.

4. Any Hi-Tech Pro products manufactured and supplied by the aforementioned two companies are not authorized by nor sourced from our company. Both of them has not obtained the appropriate intellectual property license issued by the Licensor Mr KT Leung （hereinafter called “the Licensor”）.

5. Any products manufactured and sold in the name of Hi-Tech Pro without the intellectual property license issued by the Licensor are counterfeit goods and has violated the Intellectual Property Ordinance. We will report these violations to Custom & Excise Department and will take legal actions for liability claims.

6. Any product certificate and letter of authenticity of Hi-Tech Pro products shall only be endorsed by the Licensor with unique QR code, water mark and special common seal.

7. Mr KT Leung is the only product inventor and designer of Hi-Tech Pro products and holds all the intellectual property right, title and interest of Hi-Tech Pro products and trademarks. Mr KT Leung also co-owns all Hi-Tech Pro test reports, assessment reports and performance certificates together with our company.

Further to our Important Notice 3, our company learned that a group headed by Mr. TSUI Hon Wing , Terry (hereinafter called “Terry TSUI and others”), in conjunction with Messrs. Patrick Mak & Tse, falsely claimed that they have been authorized by the board of directors and applied for the originating summons in the name of the company from the High Court, requiring the licensor Mr. LEUNG Kam Tak (hereinafter called the “Licensor”) to transfer the HI-TECH PRO trademark to the company.

The company also recently received complaints from several clients, stating that they received a letter from Messrs. Patrick Mak & Tse, mentioning the High Court case HCMP 1258/2020, and threatened them that would hinder the FSD inspections of their projects involving HI-TECH PRO fire shutters and smoke curtains. The threat made the clients concerned feeling angry and uneasy.

According to the aforementioned events, we would hereby make the following announcement and clarification in conjunction with the Licensor:

1. Our company has never approved or authorized the board of directors or Terry TSUI and others to file the aforementioned legal proceedings in the name of the company.

2. Our company has never appointed or authorized Messrs. Patrick Mak & Tse to represent our company to file the above-mentioned legal proceedings and send the above-mentioned letters to our clients.

3. Regarding the above litigation, we learned that the licensor has appointed a lawyer to apply for an injunction order to terminate the above litigation.

4. Our company has reasons to believe that someone deliberately made use of the name of our company to file the above-mentioned legal proceedings and used the case to intimidate all parties and clients in order to achieve the purpose of destruction.

5. According to reliable documentary evidence, Terry TSUI and others, without the consents of the company and the Licensor, issued an instruction to Leading Edge Construction Materials Testing Co., Ltd. and asked for changing the sponsorship of the test reports of HI-TECH PRO to Sherex Engineering Co., Ltd. as early as September 3 last year.

6. According to reliable documentary evidence, Terry TSUI and others, without the consents of the company and the Licensor, transferred, sold or shared the trademark of HI-TECH PRO to Lady LEUNG Ka Yan, the shareholder and director of Sherex Intumescent Fire Shutter Company Ltd. on October 25 last year.

7. According to reliable documentary evidence, Terry TSUI and others, without the consents of the company and the Licensor, appointed or assigned the production of HI-TECH PRO to Sherex Engineering Co., Ltd. and its associates on November 28 last year.

The aforementioned evidences clearly show that Terry TSUI and others intend to seize the intellectual property rights of HI-TECH PRO by tricky and deceitful ways, to organize a new start to operate the business of HI-TECH PRO by them or others. Our company will work with the Licensor to file legal proceedings and compensation against related parties.

In the past twelve months, our company repeatedly received complaints from different construction companies. They alleged that a Chinese male in the name of Terry TSUI made use the title of Managing Director or Executive Director of our company for approaching major construction companies in Hong Kong both by mail and personal contacts. He repeatedly interfered the tendering processes and project operations of these construction companies with threatening language. He claimed that he has executed his authority to appoint Sherex Engineering Ltd as the manufacturer and Sherex Intumescent Fire Shutter Company Ltd. as the agent of our branded products. He also claimed that he was the one being authorized to sign the letter of authenticity for all our products. Only those fire shutters supplied from Sherex Engineering Ltd. or Sherex Intumescent Fire Shutter Company Ltd. can pass the FSD inspection and can obtain the required occupation permit.

We would hereby announce and clarify that our company has never appointed a person named Terry TSUI as the Managing Director and/or Executive Director of our company. Our company has deleted the post of Managing Director and Executive Director since 31st July 2019. Our company have not authorized nor directed anybody to interfere the tendering processes and project operations of other companies whilst it is illegal. All these events seriously damaged the reputation of our company and are likely to bring liabilities to our company. For these reasons, we would take this opportunity to express our deepest apology to those involved construction companies and their responsible persons. If you or your company cannot tolerate such nuisance or disruption, we strongly advise you to call for assistance from police. We have taken corresponding action against these events.

Please be informed that a new manufacturing plant for “Hi-Tech Pro” shutters and curtains has been set up in Dongguan after shutting down of the production line in Shenzhen. This unique plant is continuously led by our product inventor Ir Prof. KT Leung. The plant is being progressively upgraded its production capacity by automation with targeted output reaching to 5,000 sets annually. We would assure all of you to have our continuous supply of our quality professional fire rated products in full range and total solutions on fire separation and compartmentation.
